A. The Nuclear
Law Institute
The Nuclear Law Institute (NLI) was established by the IAEA in order to meet the increasing demand for legislative
assistance by Member States.
The Institute offers every year a two-week
intensive training in Vienna for up to sixty lawyers from Member
States in all areas of nuclear law and in drafting corresponding national
legislation.
B. About NLI
Background – nuclear
law and legislative assistance
Nuclear energy may pose special risks to the health
and safety of persons and to the environment. At the same time,
nuclear energy holds significant benefits in a variety of fields –
from medicine, agriculture and industry to electricity production.
Its dual nature, combined with the complexity of nuclear science,
explains why, from the earliest days of its development to its most
modern uses, nuclear energy has been considered to require special
legal arrangements, in order to
ensure that it is safely and securely managed.
For many years, the IAEA has assisted Member
States individually and on a regional basis in developing their
respective national laws for the peaceful uses of nuclear energy and
ionizing radiation.
In light of the increasing number and complexity
of international instruments adopted in the areas of nuclear safety,
security, safeguards and liability, and in order to better meet the
demand from Member States for legislative assistance, specifically
for training and for capacity building, the Office of Legal Affairs
decided in 2011 to streamline its legislative assistance activities
by establishing a Nuclear Law Institute, in cooperation with the
Department of Technical Cooperation.
Following the positive feedback received with
regard to the 2011 Session, the Secretariat has decided to
henceforth organize the NLI as an annual event.
Training objective
By the end of the training session, participants should
have acquired a solid understanding of all aspects of nuclear law
and be able to draft, amend or review national nuclear
legislation.
Certificate
Upon completion of the training, participants
will receive a certificate of attendance.
C.
Curriculum
Teaching Methodology
Drawing on modern
teaching methods based on interaction and practice, the NLI
provides a combination of "impulse" lectures covering the
fundamentals of nuclear law; facilitated small-group (so-called "TOP") sessions
focusing on the implementation of the information from the lectures; and a
number of legislative drafting exercises.
An "impulse" lecture is a lecture lasting no longer than 40-45
minutes with strong key messages and a clear learning objective
leading into smaller group sessions, so-called TOP Sessions.
TOP sessions are intended to give participants the opportunity to
discuss in a structured manner the content of the lecture and relate
it to their own experience and objectives.
In addition, Special Sessions allow participants to gain in-depth
knowledge of ancillary topics of specific interest.
The Issue Forum concludes the
training session by allowing
participants to present the results of a special project
assigned to them during the course.
The learning process is complemented by
printed and on-line material.
Programme
The NLI takes
place over a two-week period and addresses the following aspects of nuclear law:
- Nuclear
Safety (including transport of radioactive material)
- Nuclear
Security
- Safeguards
and Non-proliferation
- Nuclear Trade
- Nuclear
Liability and Insurance
In addition, the
following specific subjects are addressed in the context of Special
Sessions:
- The Relationships between Environmental
Law and Nuclear Law
- Law of the Sea
- Transparency of Nuclear Activities and Public Communication
Teaching staff
All lectures and
presentations are delivered by well-known experts from the IAEA and
other institutions.
D. Admission
Requirements
Participation in the
NLI takes place within the framework of relevant IAEA Technical
Cooperation (TC) projects. Participants are thus selected in the
context of such projects among candidates nominated by Member States
through the appropriate governmental channels. Applications
submitted directly by candidates will not be considered.
In order to allow the broadest representation of IAEA Member
States, and due to the limited number of places available, only one
candidate per Member State will be considered. National Liaison
Officers are encouraged to contact the Programme Management Officers
at the Department of Technical Cooperation early on to ensure that
participation in this event contributes to relevant technical
cooperation projects.
Candidates should be
legal experts or regulators employed in governments and relevant
national agencies involved in the drafting of nuclear-related
national legislation.
Candidates should have
an excellent knowledge of English, including, as far as possible, legal
terminology. Neither translation nor interpretation into any other
language will be provided for the training session.

here. Applications to the 2012 course should reach the
IAEA no later than 6 May 2012.
Cost and funding
Participation in the
NLI is free of charge. The IAEA will cover the
travel and accommodation expenses of participants as per IAEA rules and practices.
E. Practical
Information
Venue
The training will take place on the
premises of a specific seminar hotel in Vienna (details to be
found on the NLI website at a later stage).
Travel dates
Participants
are expected to arrive in Vienna, check-in at the hotel and register
for the course on the Saturday preceding the commencement of the
training. Check-out is on the Saturday following the last day of the
course.
Accommodation
Participants are accommodated in the
same hotel where the course takes place. The Agency will make
reservations for all selected participants; there is no need,
therefore, for participants to make their own reservation.
Language
The course will be
conducted in English only.
Dress code
Participants may dress casually throughout the course.
